The Adjudicating Officer's findings that the alleged self-trades did not create artificial volumes were erroneous, and both Marwadi (as stock broker) and Chandarana (as client) were held responsible for executing self-trades in BGIL on its listing day, with a penalty of Rs.5,00,000/- imposed on each.

Page 2 of 36 terminal for a total of 22,652 shares on BSE and NSE, allegedly creating artificial volumes and misleading appearance of trading in the scrip of BGIL on the listing day.
Page 3 of 36 21. Further, I find that from amongst the total volume of 8,83,04,275 shares traded in the scrip of BGIL on both the exchanges on the day of listing, 1,89,459 shares have been alleged to have been traded by CIBPL in nature of self trades, which is including matching of trades from different terminals, constituted for 0.21% of total volumes in the scrip of BGIL on the listing day on BSE and NSE. The said matching of trades is due to trades getting executed from different terminal by different dealers. Also, I note from the submissions of the Noticee that the quantities which were getting matched were less in number and only on account of the system settlement. However, the extent of concentration on the day of listing is exceptional and unacceptable even in any extreme volatile situations. The Noticee should look into this aspect and remedial steps should be taken for avoiding such instances. Further, there is no allegation against the Noticee that it had indulged in price manipulation.
