Page 2 of 9 3. During the course of investigation, it was inter alia revealed that Sanghavi Brothers Brokerage Ltd. (hereinafter referred to as ‘noticee’), registered with SEBI as stock broker, bearing registration no. INB 010992132 had dealt in the scrip of Baffin and executed synchronized trades on behalf its client namely Paragon Investments Pvt. Ltd. (hereinafter referred to as Paragon).
Page 3 of 9 to take such action in the manner as it deemed fit. A copy of the Enquiry Report was also forwarded to the noticee along with the said SCN.
Page 4 of 9 7. I have carefully considered the Enquiry Report, the SCN issued to noticee and reply thereof. The noticee has argued that while punching order in live market conditions, it is not possible to know the total market volume of the day. I note that at the end of trading day the broker can get to know about the total traded volume in the scrip and at the same time the broker has the knowledge about its own trades in the scrip. In the present case the client of the noticee was trading regularly during the period and it had the knowledge about the traded volumes of the client. In view of this, I find no merits in the argument of the noticee.
