SEBI held that the auditor's reports by Deloitte Haskins & Sells were incomplete and insufficient to ascertain ownership of securities held in the beneficiary accounts of Alka Securities Limited and Mahesh Kothari Shares and Stock Brokers Private Limited, and therefore no directions could be issued for transfer of such securities based on those reports alone. Instead, an alternate mechanism — a Committee constituted by NSE and BSE chaired by an independent expert — was directed to be set up to identify owners and release securities to clients.
