The Noticee had executed alleged ‘paired contracts’ on behalf of its clients under their instructions and authorization. The Noticee had never induced or given advice to any of its clients. The clients had executed trades on their own and no funding was given to them. 7.4. None of the Noticee’s clients had raised any complaint against it. 7.5. There was no connection or association between the Noticee and NSEL other than as a Broker. 7.6. The Noticee had carried out transactions in due compliance of the Bye Laws, Rules, Regulations and circulars issued by NSEL and no grievance was raised against them by NSEL. 7.7. The turnover in the alleged paired contracts was miniscule in comparison to the Noticee’s total turnover in other Commodity Exchanges. 7.8. The Noticee has submitted affidavits from 5 of its clients who traded in NSEL paired contracts stating that they had executed trades on their own decision and no funding was given to them. 7.9. The Noticee had executed trades on NSEL platform when at the relevant time around 500 Brokers were executing trades through thousands of terminals for lacs of clients including Government companies and Organizations like MMTC, FCI, NAFED, etc. No adverse remark/red flag were raised against any of the entities who were also purported to be closely associated with NSEL and alleged paired contracts.
