The main issue that arises here is, as to whether the Noticee was in possession of any unpublished price sensitive information and whether he communicated such unpublished price sensitive information to his family members (mother), who thereafter, purchased the shares of the Company and made unlawful gains. If yes, then whether such acts of the Noticee are in violation of the provisions of regulation 3 (i) and/or 3 (ii) of the PIT Regulations.
