Page 2 of 3 vide Order dated November 09, 2012 under Section 15-I of the SEBI Act read with Rule 3 of the Securities and Exchange Board of India (Procedure for Holding Inquiry and Imposing Penalties by Adjudicating Officer) Rules, 1995 (hereinafter referred to as the “Adjudication Rules”), to inquire into and adjudge under Section 15HB of the SEBI Act, the alleged violations committed by the Noticee.
Page 3 of 3 name of "Bhagawati Oxygen Ltd". Upon perusal of records of Registrar of Companies Delhi and the PAN of the Noticee it is observed that the name of the Noticee is correctly spelt "Bhagawati Oxygen Limited" and they had already obtained login ID in SCORES system.
SHOW CAUSE NOTICE, REPLY AND HEARING 5. A show cause notice (hereinafter referred to as "SCN") no. NRO/ AO/ GRMR/ SKG/ 4424/2013 dated February 20, 2013 under Rule 4(1) of the Adjudication Rules was served on the noticee advising it to show cause as to why an inquiry should not be held against it in terms of Rule 4 of the Rules read with Section 15-I of SEBI Act for the alleged violations to have been committed by the Noticee and why penalty should not be imposed under Sections 15HB of the SEBI Act. The copies of the documents relied upon in the SCN were provided to the Noticee along with SCN.
