Page 3 of 4 the Noticee by the aforesaid letter. The said letter dated April 23, 2005 was duly delivered at the then address of the Noticee viz., 12/1. Delhi Mathura Road, Faridabad‐ 121003. It is observed from the aforesaid letter of SEBI that the investor grievances mentioned therein had earlier been referred to the Noticee for redressal during various periods. In spite of the same the Investor complaints remained unresolved for more than eight years.
Page 4 of 4 (c) the repetitive nature of the default. 12. I have considered the guiding principles laid down under Section 15J of the SEBI Act to determine the quantum of penalty. The amount of disproportionate gain or unfair advantage made by the Noticee and the amount of loss caused to the investors as a result of a default of this nature are difficult to quantify. However, incidences of this nature definitely compromise the securities market regulatory framework, to the detriment of investors at large. I observe that there were 19 complaints pending for redressal for non‐receipt of refund order, 168 complaints pending for redressal for non‐receipt of dividend, 139 complaints pending for redressal for non‐receipt of share certificate, 30 complaints pending for redressal for non‐receipt of debenture certificate and 4 complaints were pending for redressal for non‐receipt of annual reports, interest on delayed payment of refund, etc. The Noticee has not taken any steps to redress the said complaints. The number of unresolved investor grievances bears testimony to the repetitive nature of the default.
