Shantha Bai (hereinafter referred to as the ‘Noticee’) was one of the entities, alleged to have dealt fraudulently in the scrip of MCL for which the Noticee alleged to have violated the provisions of Regulation 3(a) of the SEBI (Prohibition of Fraudulent and Unfair Trade Practices relating to Securities Market) Regulations, 2003 (hereinafter referred to as the ‘PFUTP Regulations’). Therefore, the instant proceedings has been initiated against the Noticee for which the Noticee is liable for monetary
Page 3 of 10 asking her to show the cause as to why an enquiry should not be held against her and penalty, as prescribed be not imposed under Section 15HA of SEBI Act for her alleged violation of Regulation 3(a) of the PFUTP Regulations. The Noticee had not filed any detailed reply to the SCN with respect to the allegation made against her. Instead, the Noticee vide her letter dt 06th July, 2008 sought an adjournment for personal appearance. Subsequently, the Noticee had once again requested the undersigned to adjourn for personal hearing vide her letter dt. 6th August, 2008. However, as mentioned above, the Noticee had not filed any reply pertains to the charges leveled in the SCN against her
