Page 3 of 11 2008 under Rule 4 of the Adjudicating Rules was issued to the Noticee by the undersigned, asking it to show the cause as to why an enquiry should not be conducted against it and penalty, as prescribed be not imposed under Section 15HA of SEBI Act for its violation of the provisions of Regulation 4(1), 4(2) (a) and 4(2) (e) of PFUTP Regulations. The Noticee vide his letter dt. June 10, 2008 had sought time to file his reply. However, no reply was filed by the Noticee with respect to the above SCN.
Page 4 of 11 gave another opportunity of personal hearing advising the Noticee to appear before him on April 22, 2010 and specifically asked the Noticee to intimate the undersigned, in case he applies for the consent proceedings. However, the Noticee neither appeared for personal hearing nor made any correspondence in respect of his consent application. Therefore, the matter is now proceeded on the basis of documents available on record.
