These entities who transacted in the shares of MCL entered into synchronized and structured deals that led to creation of misleading appearance of trading in the scrip of MCL and artificial volumes in the scrip and distorted market equilibrium leading to sudden spurt in the volume and price of the scrip.

3 of 11 response to the hearing notice sent to the Noticee dated February 4, 2009, had stated that he had already given his reply in writing on March 22, 2007 and April 12, 2007 to respective officer in the investigation department, SEBI. He had annexed those replies to his letter dated February 7, 2009, the submissions of which will be put forth in the following paragraphs. In the letter dated February 7, 2009, he had stated that no cheque has been issued from his account and all cheques and DDs are accepted by the broker without any consent from his side, which proves that he is no where connected with this matter. The following are the points made by the Noticee in his replies dated March 22, 2007 and April 12, 2007 sent to the Investigation Department of SEBI and copies of which are annexed to his reply dated February 7, 2009:

However, another opportunity of hearing was granted to him in the interest of Principles of Natural Justice on May 18, 2009 vide notice dated May 8, 2009 at the SEBI Head Office situated at Bandra Kurla Complex, Mumbai. However, the envelope containing the hearing notice returned to SEBI and it had the following words written on it: ‘person is left’. When enquired at the office where Noticee is working through the office landline number given on the acknowledgment card, they stated that the Noticee had left the job and did not leave any details of his, like phone number or house address with the employer.
