The undersigned was appointed as the Adjudicating Officer vide order of SEBI dated 20th February,2008 under section 15-I of the SEBI Act r/w Rule 3 of SEBI (Procedure for holding Inquiry and Imposing Penalty by Adjudicating Officer) Rules,1995 (hereinafter referred to as the ‘Adjudicating Rules’) to inquire into and adjudge under Section 15HB of the SEBI Act, the alleged violations of the abovementioned provision of the Brokers Regulations committed by the Noticee. Thereafter, considering the material available on record, it was decided by the undersigned to conduct an inquiry in the instant matter for which the Noticee was given personal hearing on July 15, 2009. On the scheduled date of hearing, the Noticee appeared through its authorized representative and made submissions. However, during the hearing proceedings, it had expressed its desire to apply for the consent proceedings in the instant matter and therefore time upto July 30, 2009 given for filing of the consent applications. These hearing proceedings were reduced into writing and duly signed copy of the same was given to the Noticee.
