Page 2 of 13 was 198% in 46 trading days. During the period from December 30, 2003 to June 30, 2004, the price of the scrip gradually increased from ` 63.5 to ` 73.8 on March 3, 2004. Thereafter the scrip traded from ` 54.9 to ` 72.05 till May 4, 2004. Thereon the price of the scrip started falling and touched ` 56.55 on May 05, 2004 to ` 29 on June 24, 2004. At NSE, the price opened at ` 30.30 and touched a high of ` 88.60 and a low of ` 29.50 and closed at ` 31.65. The variation between high and low price was 200.34% while the variation in open and the closed price was 4.46 %.
Page 3 of 13 6. It was alleged in the SCN that the Noticee dealt heavily in the said scrip through brokers viz. Magnum and Maniput which were sister concerns and M/s. Bipin R Vora. The total turnover of Noticee’s dealings through Magnum and Maniput in PECL for 2003 – 2004 were 22,85,10,542 and 8,03,82,924 respectively. Noticee had also dealt in the account of Mrs. Roma Khatri who is the wife of the Noticee. The details of the transactions entered by the Noticee through the said brokers were provided to the Noticee as an Annexure I to the SCN. It was also alleged that Noticee had put large buy and sell orders and deleted the most of the orders prior to its execution. The details of the same were provided to the Noticee as an Annexure II to the SCN. It was alleged that the Noticee placed huge orders and thereafter deleted the same before its execution just to create artificial depth in market with respect to the said scrip. It was also alleged that while dealing in the said scrip through M/s. Bipin R Vora, Noticee had used special privileges from it i.e. credit limit without charge of interest. It was alleged that the Noticee bought heavily in the month of July 2003 and sold the said shares in the month of November 2003 and also executed fictitious trades which contributed to false market as no delivery of shares or money had taken place for the said transactions. Page 4 of 13 sold the said shares at Rs. 45.9 in a period of 15 Months. We sold 236184 shares purchased in the month of November 2003 at an average price of Rs.43. Thereafter, the price rose to Rs.85 in a month period. If a person had inside information then why he would sell at Rs. 43 instead of Rs. 85 in December 2003. The balance quantity that we were holding was sold in May and June 2004 at Rs. 40. iii) Whatever shares we have purchased, we have asked for delivery which is very clear from the ledger and copy of bills indicate that broker had debited full delivery amount to us. iv) With regard to price fluctuations, the shares were traded in normal group between June 2003 and December 2003 but in 2nd week of December, BSE and NSE transferred the said scrip to T group. So, there was restriction in trading / jobbing and all the activity in the scrip became delivery based only. So, the volume in the scrip gradually decreased and the price reduced to Rs. 65. v) On May 27, 2004, when BJP lost the election, decision about new government became uncertain and market crashed and Nifty also touched the lower circuit twice and not only PECL but all the shares price were affected and dropped by 25%. PECL went down to Rs.35 in the month of May 2004.
