The undersigned was appointed as the Adjudicating Officer vide order of SEBI dated 20th February,2008 under section 15-I of the SEBI Act r/w Rule 3 of SEBI (Procedure for holding Inquiry and Imposing Penalty by Adjudicating Officer) Rules,1995 (hereinafter referred to as the ‘Adjudicating Rules’) to inquire into and adjudge the instant matter under Section 15HB of the SEBI Act, the alleged violations of the abovementioned provision of the Brokers Regulations committed by the Noticee. We submit that it is impracticable and unfeasible for a stockbroker to detect and perceive the intentions of a client and the concept of due diligence can not be extended in a manner to suggest that the intentions and objective of a client should always be known to a stockbroker. • … we have not funded nor provided shares to our client for the execution of the said trades.
