Page 2 of 9 in circular trading, reversal of deals and exchange of funds and securities. Shri Narendra Ganatra (hereinafter referred to as the ‘Noticee’) was one of the major clients who had allegedly traded in a fraudulent and unfair manner and indulged in manipulation in the scrip of SCL.
Page 3 of 9 cause as to why an inquiry should not be held against him and penalty be not imposed under Section 15 HA of the SEBI Act for his alleged violation of the provisions of Regulations 4 (1) and 4 (2) (a), (b), (d) & (e) of the PFUTP Regulations.
Page 4 of 9 March 11, 2011 again provided an opportunity of personal hearing to the Noticee on March 21, 2011 and also stated therein that the adjudication proceeding was being proceeded with against the Noticee relying on the SCN and other material already made available to him. The authorized representative of the Noticee attended the said personal hearing during which he sought clarification on the data contained in the annexures provided. The trade data as given in the annexures with details of relevant counterparties was explained to him. The authorized representative sought complete trade and order log of all transactions with all details, and also other records and documents collected by SEBI.
