Page 2 of 10 in circular trading, reversal of deals and exchange of funds and securities. Shri Piyush Shah (hereinafter referred to as the ‘Noticee’) was one of the major clients who had traded in a fraudulent and unfair manner and indulged in manipulation in the scrip of SCL.

The Noticee vide letter and email dated February 22, 2011 submitted that he had received intimation over phone about the personal hearing scheduled on February 22, 2011 but had not received the written notice. The Noticee also submitted that he would not be able to attend the said personal hearing as his physical condition was not fit and requested for another hearing next month. The undersigned vide letter dated February 22, 2011 again granted an opportunity of personal hearing to the Noticee on March 10, 2011. However, the said letter, sent for hand delivery, returned undelivered. The undersigned vide letter March 09, 2011, sent by ‘Speed Post Ack. Due’ provided a last and final opportunity of personal hearing to the Noticee on March 21, 2011. A soft copy of the said letter was also forwarded to the email address of the Noticee. However, the Noticee failed to attend the said personal hearing.
