Page 2 of 13 record. The Noticee failed to furnish the information as required. This has resulted in non-compliance of the summons.
Page 3 of 13 was sent to the Noticee through “Registered Post with A/d” but it was returned undelivered with the remark “intimation posted”. Subsequently, the said SCN was served on the Noticee by affixture on May 13, 2010 at his last known address as provided for in the Adjudicating Rules.
Page 4 of 13 closed’. Another opportunity was granted to the Noticee on October 22, 2010 vide Notice of Hearing dated October 5, 2010. The said hearing notice was affixed at the last known address of the Noticee as per the Adjudicating Rules. Subsequently, the Noticee vide letter dated October 19, 2010 stated that he came to know that he was given a hearing on October 22, 2010 and that he had not received the earlier notices of hearing dated September 2, 2010 and September 13, 2010. On the scheduled date of hearing viz., October 22, 2010, the authorised representative of the Noticee Ms. Prachi Pande had appeared, requested for certain documents including the earlier notices and sought time to appear before me. Accordingly, the documents requested for have been provided to her and another opportunity of hearing was granted on October 29, 2010 vide notice of hearing dated October 22, 2010.
