Therefore the investigating authority issued summons to the FTEL seeking various information and documents and also to appear before him. However FTEL did not appear or submit any information in compliance with the summons. It resulted in the violation of Section 11C (2) read with 11 C (5) of the Securities and Exchange Board of India Act, 1992 (hereinafter referred to as the SEBI Act).

Page 3 of 11 2010 appointed the undersigned as the AO in the instant matter subsequent to the transfer of Mr. Deore to the Enforcement Department of SEBI.

Page 4 of 11 granted an opportunity of personal hearing to the Noticee by issuing a letter dated December 24, 2010 advising it to appear before me on January 13, 2011 for the personal hearing. The notice of hearing was served on the Noticee through the Vadodara Stock Exchange by affixing the same at its last known address. The said hearing was scheduled by the AO at SEBI Head Office, Mumbai. The Noticee however, did not appear before the undersigned for the said personal hearing.
