Investigation revealed that certain entities had executed fraudulent trades and created artificial volume and price manipulation in the scrip of PEL. Shri Keshav Saraf and his wife Ms. Renu Saraf (hereinafter together referred to as the ‘Noticees’) are among such entities.

It is alleged in the SCN that the Noticees had executed fraudulent trades which created false and misleading appearance of trading and price manipulation in the scrip of PEL during the period under investigation. Their trading details at BSE and NSE were given as Annexures to the SCN. During the period from November 29, 2006 to December 11, 2006, the price of the scrip of increased by 121% in 9 trading days with average volume of share traded being 7,19,047 shares. Shri Keshav Saraf dealing through trading member Ashika Stock Broking Ltd. contributed to new price discovery including first trades for a total price rise of ` 23.95 and ` 11.85 at BSE and NSE respectively during the said period. Analysis of Last Trade Price (LTP) showed that cumulative sum of LTP was higher for trades executed by Mr. Keshav Saraf. He made a gross purchase of 6,69,295 and 8,30,417 shares at BSE and NSE respectively and a gross sale of 6,68,295 and 8,31,720 shares at BSE and NSE respectively. Ms. Renu Saraf, wife of Keshav Saraf, purchased and sold 1,15,000 shares in the scrip of PEL on December 06, 2006 at NSE.

Subsequently, the undersigned granted another opportunity of personal hearing to the Noticees on September 29, 2011. The Personal hearing was attended by their authorised representative who made oral submissions and also submitted written submissions.
