A Show Cause Notice dated March 18, 2011 (hereinafter referred to as ‘SCN’) was issued to the Noticee in terms of the provisions of Rule 4 of SEBI (Procedure for holding Inquiry and Imposing Penalties by Adjudicating Officer) Rules, 1995 (hereinafter referred to as the Adjudicating Rules) requiring the Noticee to show cause as to why an inquiry should not be held for the violations alleged to have been committed by it.

SEBI vide letter dated July 28, 2010 once again directed the Noticee to redress 316 grievances out of 391 pending grievances against the Noticee within 7 days of the receipt of the letter. The Noticee was also directed to submit ATR in the proforma prescribed by SEBI. The Noticee failed to redress the investor grievances and submit the ATR in the proforma prescribed by SEBI. The Notice vide letter dated August 09, 2010 sought an extension of 2 weeks to submit the ATR in format prescribed by SEBI. Thereafter, the Noticee vide letter dated August 11, 2010 submitted the status of 316 Investor Complaints which is not as per the proforma. It is alleged that the Noticee violated S.15C of SEBI Act by its failure to redress the investor grievances and to submit ATR in the proforma as prescribed by SEBI within the stipulated time.
