Based on the above facts, investigation into the affairs relating to buying and selling or dealing in the shares of the company was conducted by SEBI to ascertain whether any provision of the SEBI Act , 1992 and various rules and regulations made there under had been violated during the investigation period.

The noticee appeared and during the course of personal hearing the noticee and pleaded ignorance of opening of the demat account. He also submitted that Jatin Shah took his photograph and also other documents such as proof of address , date of birth etc on the pretext of applying for passport for the noticee and misused all those documents and opened demat account in his name which he was not aware. The noticee also submitted that he did not receive his passport and Jatin Shah did not return his documents. Further, the noticee also submitted that when he became aware of the same then he also lodged a police complaint dated August 16, 2005 against Jatin Shah , Manubhai B Shah , Varsha Jatin Shah , Kamlesh Hasmukhlal Shah , Chandrakant B Mehta and Vasant C Shah. The said police complaint is on record. The noticee further submitted that he has never received any shares not traded in the stock market. The noticee also submitted that he has not received any money from Jatin Shah and requested not to impose any
