Adjudication Order in respect of G-Tech Info Training Ltd. Page 3 of 10 5. Consequent upon the transfer of Mr. V.S Sundaresan, the undersigned was appointed as the Adjudicating Officer vide order dated December 10, 2009.
Adjudication Order in respect of G-Tech Info Training Ltd. Page 4 of 10 9. I am convinced that ample opportunities have been given to the Noticee to explain its case. As per rule 4(7) of the Rules, if any person fails neglects or refuses to appear as required by sub-rule (3) before the Adjudicating Officer, he may proceed with the inquiry in the absence of such person after recording the reasons therefor. The noticee is aware of the proceedings against it as it had received the show cause notice. It is also aware of the opportunities of hearing granted on June 21, 2010 and July 12, 2010. Despite having been given ample opportunities, the Noticee has failed to make any submissions in its defence. I am, therefore, compelled to proceed with the matter ex-parte based on the material available on record.
