Page 3 of 8 4. It was alleged that one of the entities, viz., M/s. Tirumala Vyapaar Pvt. Ltd. (hereinafter referred to as “Noticee”), client of Badri Prasad & Sons, Member, CSE (hereinafter referred to as “BPS”) violated the provisions of regulations 4 (2) (a) and 4 (2) (e) of SEBI (Prohibition of Fraudulent and Unfair Trade Practices Relating to Securities Markets) Regulations, 2003 (hereinafter referred to as “PFUTP Regulations”) and therefore, liable for monetary penalty under section 15HA of Securities and Exchange Board of India Act, 1992 (hereinafter referred to as “SEBI Act”).

In the interest of natural justice and in order to conduct an inquiry as per rule 4 (3) of the Rules, the Noticee was granted an opportunity of personal hearing on February 18, 2010 at SEBI’s Eastern Regional Office, Kolkata vide notice dated January 8, 2010. The hearing notice was affixed and the Noticee did not attend the hearing. The Noticee was granted another opportunity of hearing on March 15, 2010 at SEBI’s Head Office, Mumbai. However, again the hearing notice was affixed and the Noticee did not attend the hearing.
