I am of the view that before proceeding in the matter on its merit, it would be in the fitness of the thing to first decide the preliminary issue as to whether in view of the death of Shri Sumantlal C Shah, the present Adjudication Proceedings against Shri Sumantlal C Shah, would continue or abate.
