Adjudication Order in respect of Mr. Ramdas Janardhana Kamath in the matter of Acropetal Technologies Ltd. Page 2 of 4 2009 (hereinafter referred to as “ICDR Regulations”), SEBI (Prohibition of Fraudulent and Unfair Trade Practices relating to Securities Market) Regulations, 2003 (hereinafter referred to as “PFUTP Regulations”), SEBI ( Merchant Bankers) Regulations, 1992 (hereinafter referred to as “Merchant Bankers Regulations”) and Securities Contracts (Regulation) Act, 1956 (hereinafter referred to as “SCRA”) with regard to the following: i. Bidding process in the IPO of ATL. ii. Examination of disclosures made by the company in the offer documents / prospectus and deviations from objects of issue, if any. iii. Examination of fund flows from IPO proceeds.

Relying, on the aforementioned Orders of Hon’ble Supreme Court and Hon’ble Securities Appellate Tribunal, I am of the view that the adjudication proceedings initiated against the deceased Noticee will not survive and is liable to be abated without going into the merits of the case. Consequently, no penalty is imposed on the Noticee, who is since deceased, and the Adjudication Proceedings against her stand abated.
