Adjudication Order in respect of CPR Capital Services Limited in the matter of NSE Co- Location Page 2 of 34 initiated against the Noticee for the alleged violations of provisions of sections 11C(2), 11C(3) r/w section 11(2)(i) of the SEBI Act, 1992, point 2(a) of Chapter V of NSE bye-laws r/w clauses A(2) and A(5) of the Code of Conduct specified under Schedule II r/w regulation 9(f) of the Stock Broker Regulations, 1992 and regulations 3(b), 3(c), 3(d) and 4(1) of Securities and Exchange Board of India (Prohibition of Fraudulent and Unfair Trade Practices Relating to Securities Market) Regulations, 2003 (hereinafter referred to as PFUTP Regulations, 2003) and sections 12A(a), 12A(b) & 12A(c) of the SEBI Act, 1992.

Noticee connected to secondary server for 44 trading days in CD/IRF segment and 10 trading days in CM segment during the review period and the details are as follows: Year 2010 2011 2012 2013 2014 Number of trading days connected to the secondary server in CM segment - - 10 - - Number of trading days connected to the secondary server in CD / IRF segment - - 35 9 - iii. Noticee was reprimanded by NSE for connections made to secondary server on Nov 18, 2011 and May 18, 2012.
