Penalties) Rules, 1995 (hereinafter referred to as “Adjudication Rules”) vide Order dated July 02, 2021 and the Communique for appointment dated July 06, 2021, to inquire into and adjudge under section 15HA of the SEBI Act, the alleged violation of the aforesaid provisions of PFUTP Regulations by the Noticee. Subsequently, vide Order dated August 24, 2022 and the communique dated August 29, 2022, the undersigned was appointed as the Adjudicating Officer, in the said matter.
ORDER 7. Relying on the aforementioned order, I am of the view that the instant adjudication proceedings against the Noticee are liable to be abated without going into the merits of the case qua her and the SCN dated December 28, 2021 issued against her is disposed of accordingly.
SHOW CAUSE NOTICE AND REPLY 4. A Show Cause Notice bearing reference no. OIAE/IAD/PJ/KM/39631/1/2021 dated December 28, 2021 (hereinafter referred to as “SCN”) was issued to the Noticee under Rule 4(1) of the Adjudication Rules to show cause as to why an inquiry should not be initiated against her and why penalty should not be imposed upon her under Section 15HA of the SEBI Act for the violations alleged to have been committed by her. The Noticee was advised to file a reply to the SCN within 14 days from the date of the receipt of the notice, failing which it shall be presumed that the Noticee does not have any reply to submit and the matter would be further proceeded with on the basis of the evidence available on record.
