Before proceeding in the instant case, it may be necessary to settle a preliminary issue of service of SCN and hearing Notice on the Noticee. As already stated above, efforts were made to serve the SCN on the Noticee at its address as obtained from the portal of MCA through post which however failed as the said address was “not known” to the postal department. Thereafter, the Hearing Notice was published on October 10, 2019 in leading national and vernacular dailies having circulation at the place where the last known registered office of the Noticee was located. This was noticed by the Noticee and letter dated October 25, 2019 was received from it in response to the said Notice. The subsequent communication to the Noticee sent at the address available on the letter dated October 25, 2019, received from the Noticee, could not be delivered yet again through post. Finally, the Noticee was provided last and final opportunity of hearing on February 11, 2020 vide public notice dated January 21, 2020, published on February 5, 2020. No response has been received from the Noticee despite these efforts. I therefore, hold that the principles of natural justice and the requirements for a valid service under the Rules have been adequately complied with and no further opportunity of personal hearing is necessary.
