---------------------------------------------------------------------------------------------------------------- Adjudication Order in respect of Ashok Kumar Khemka HUF 4 | P a g e in the matter of dealings in illiquid Stock Options at BSE The Noticee denies the allegation that the reversal trades alleged resulted into generation of artificial volumes in the market and hence (allegedly) treated as non-genuine trades. No objection or alert or caution was issued by the broker or BSE or SEBI in the matter of my trading. There was an inordinate delay of about 7 years in issuance of the SCN. In this regard, the Noticee has relied upon the judgment of Hon’ble SAT in the matter of Ashok Rupani Vs. SEBI and also in the judgment of Ashlesh Shah Vs. SEBI and as laid down by the Hon’ble Supreme Court in the matter of Adjudicating Officer, SEBI Vs. Bhavesh Pabari. Noticee traded only once during the entire investigation period, hence no malafide motive has been attributed in execution of trades. No investor complained of being mislead by the Noticee’s trades. No relations with counterparty and counter broker of the trade and not alleged any nexus between the Noticee and the counter party.
