Adjudication Order in respect of M/s. Classic Global Finance and Capital Limited Page 2 of 4 penalty should not be imposed under section 15C of the SEBI Act, for the alleged violation of SEBI Circular No. CIR/OIAE/2/2011 dated June 03, 2011 read with Circular No. CIR/OIAE/1/2013 dated April 17, 2013 (hereinafter collectively referred to as “Circulars”) issued by SEBI under Section 11 (1) of the SEBI Act.

It is further submitted that the Company had applied for the SCORES registration on 25th December, 2013 to SEBI in order to view the complaints pending against the Company and submit ATRs along with supporting documents electronically in SCORES to comply SEBI Circular No. CIR/OIAE/2/2011 dated 03rd June, 2011 read with Circular No. CIR/OIAE/1/2013 dated 17th April, 2013 issued by SEBI under Section 11(1) of SEBI Act.

In view of the aforesaid observations, I find that the Noticee has already obtained the SCORES authentication and there is no investor complaints are pending against the Noticee. Considering the same, I am of the opinion that it is not a fit case for proceeding further in the matter. Accordingly, the present Adjudication proceedings initiated against the Noticee namely M/s. Classic Global Finance and Capital Limited vide SCN No. SEBI- NRO/AO/VKV/GSS/1170/2015 dated August 18, 2015 is disposed of without imposition of any penalty.
