Page 2 of 14 3. SEBI conducted an investigation into the trading in the scrip of KSERA, during the period May 02, 2005 to July 1, 2005 (hereinafter referred to as ‘Investigation Period’). The Investigation Report ( hereinafter referred to as ‘IR’) observed that during the Investigation Period the price of the scrip opened at Rs.74.35 on May 2, 2005 reached a high of Rs. 97.50 on May 24, 2005 and closed at Rs. 89.25 on July 1, 2005.

Shri Vishal Vijay Shah, the son of the proprietor of the noticee and proprietor of Vishal Vijay Shah appeared for the hearing and submitted that the proprietor of the noticee, Shri Vijay Bhagwandas Shah expired on June 10, 2006 and the membership has been transmitted to him w.e.f March 2007 and the name of the firm at present is Vishal Vijay Shah.
