SEBI Circular No. CIR/MIRSD/16/2011 dated August 22, 2011 on rationalization of trading account opening process and iv. Master Circular dated December 31, 2010 on Anti Money Laundering.
Adjudication Order in respect of Edelweiss Broking Ltd. Page 3 of 15 7. Further, vide letter dated April 30, 2015, the Noticee sought certain clarifications with respect to the allegations made in the SCN.
Adjudication Order in respect of Edelweiss Broking Ltd. Page 4 of 15 period of inspection is 01.04.2010 to 20.02.2014. The ARs of the Noticee also filed reply dated January 18, 2018. The salient features of the submissions made vide the said reply are as under: a. Instances cited in the SCN relate to an earlier period i.e. 2010 and 2011. Many aspects relating to KYC have undergone regulatory changes coupled with technology related changes. b. Same PAN allocated to more than 1 UCC – 7 cases – out of these 7 cases, there are 5 cases where, accounts were opened for NRI account as 2 UCCs are required to identity the separate funds relating to NRE and NRO bank account (reference is drawn to NSE/INSP/2010/110 dated December 24, 2010). In the remaining 2 cases, these accounts were accounts of individuals and proprietorship opened before August 2011. SEBI vide circular no. CIR/MIRSD/16/2011 dated August 22, 2011 had given a guideline to open only individual accounts and restricted the account opening of proprietorship. Subsequently, after the SEBI circular, appropriate action related to proprietary accounts was initiated by the Noticee. c. Same bank account for more than 1 UCC – 1206 cases and 453 instances of bank account no. being of 3 digits or less: As per analysis, in 86% of the cases the same bank account is mapped in 2 UCC/clients and in 9% of the cases the same bank account is mapped to 3 UCC/clients.
