The Noticee, BP Equities Pvt. Limited, violated SEBI circulars dated December 03, 2009 and March 31, 2010 by delaying settlement of client accounts until April 01, 2012, failing to settle accounts with debit and credit balances, and maintaining consolidated accounts across securities and commodity segments, warranting a penalty of Rs. 5,00,000 under Section 15HB of the SEBI Act. However, the Noticee's failure to charge delayed payment charges (DPC) on debit balances was held not to be a per se violation, though the Noticee was cautioned against giving further exposure to clients with debit balances.
