In the matter of Atlanta Infrastructure and Finance Limited Page 2 | 3 3(a),(b),(c),(d), 4(1), 4(2)(a), 4(2)(e) of PFUTP Regulations by the Noticee. Subsequently vide order dated March 26, 2018, received vide communique dated March 27, 2018 the undersigned was appointed as Adjudicating Officer.

In the matter of Atlanta Infrastructure and Finance Limited Page 3 | 3 8. After taking into consideration all the facts on record and circumstances of the case, I find that the matter in respect of the Noticee, Late Mrs. Pritiben Anil Gandhi initiated vide SCN Ref: No. EAD-2/DSR/RG/1621/4/2018 dated January 16, 2018 cannot be proceeded with as the Noticee passed away on May 16, 2018 and, thus, the matter becomes infructuous and adjudication proceeding cannot be proceeded with.

SHOW CAUSE NOTICE, REPLY AND PERSONAL HEARING 3. A Show Cause Notice dated January 16, 2018 (hereinafter referred to as ‘SCN’) was issued in the matter. The SCN was issued to the Noticee under the provisions of Rule 4 (1) of the Adjudication Rules, to show cause as to why an inquiry should not be held against the Noticee and why penalty should not be imposed on the Noticee under the provisions of Sections 15HA of the SEBI Act, for the aforesaid alleged violations. No reply was received in response to the SCN.
