Noticee executed self-trades on 2,353 and 4,145 occasions in the scrip of PCL on BSE and NSE respectively during the investigation period. It was further observed that in respect of all the self-trades at NSE, Noticee itself was the broker on buy side as well as on sell side.

Adjudication Order in respect of GKN Securities in the matter of Prakash Constrowell Limited Page 4 of 9 formulated a Policy not to penalize stock brokers for self-trades of the nature where matching of small quantities is between inter-id terminals of the same broker.  Mere occurrence of self-trades is not illegal in the absence of proof of malafide intention to defraud. There is nothing in the show cause notice to suggest that there was any intentional manipulation. There is neither any manipulation in respect of self-trades nor there was any intention to enter into self-trades as per the contents of the notice.
