Ms. Anita Kenkare was appointed as the Adjudicating Officer, vide Order dated April 16, 2015 and Communique dated November 05, 2015,under Section 15 I of the Securities and Exchange Board of India Act, 1992 (hereinafter referred to as "SEBI Act"), read with Rule 3 of the SEBI (Procedure for Holding Inquiry and Imposing Penalties by Adjudicating Officer) Rules, 1995 (hereinafter referred to as ‘Rules’) to inquire into and adjudge under Section 15HA of SEBI Act, the alleged violation of the provisions of Regulations 3(a), (b), (c), (d), 4(1), 4(2)(a) and (g) of PFUTP Regulations, 2003 by the Noticee.

Page 4 of 33 9. The Noticee vide letter dated December 14,2015 submitted a reply to the said SCN. The summary of the submissions made by the AR on behalf of the Noticee is as under: we would like to humbly point out that transactions of Self trades has happened inadvertently without any malicious intention. Our company has placed orders taken one side position, however when we felt the market is going in the opposite direction we had placed counter trade positions to reverse our previous positions, so during reversal some trades of our own got matched inadvertently. In respect of these transactions entered by our company, we would like to mention as follows: a) The percentage of self trades quantity to market volume varied between 0.016% to 0.018% which is insignificant. It cannot be construed as artificial / fictitious volume in the market, Thus these self trades cannot give a false and misleading appearance of trading in the scrip at the exchange. b) The self trades has resulted into price change of script between 0 to 35 paisa which is minuscule. Thus there was no any significant change in the price of script due to these self trades. c) The company has not made any profit out of these transactions. d) The company has not caused any loss to an investor due to these transactions.
