Adjudication Order in the matter of Channel Nine Entertainment Ltd Page 2 of 12 Imposing Penalties by Adjudicating Officer) Rules,1995 (hereinafter referred to as "Adjudication Rules") to inquire into and adjudge inter alia under the provisions of Section 15 A(a) of SEBI Act, 1992 for the violation of the provisions of Section 11 (3) and 11 C (3) of the SEBI Act, 1992 by the Noticee.
Adjudication Order in the matter of Channel Nine Entertainment Ltd Page 3 of 12 Noticee failed to avail the opportunity of hearing on the scheduled date of hearing i.e May 13, 2019. Further, from the record, I also note that no submissions or communication have been made by the Noticee with respect to the SCN or the hearing Notice till date. In this connection, it is pertinent to note that the Noticee was informed that if no reply is received to the charges alleged in the SCN and no appearance is made for personal hearing, the matter shall be decided on the basis of the facts / material available on record in terms of sub-rule (7) of Rule (4) of the SEBI Adjudication Rules.
