2 (b), (e), (g) and (n) of FUTP Regulations 2003. In view of the same it is alleged that the noticee is liable to the penalty under section 15 HA of the SEBI Act.

3 hearing. It is noted that the said notice sent both by registered post and courier has been returned undelivered with the remarks “not claimed”. In view of the same the matter is being considered on the basis of the evidence available on record. CONSIDERATION OF EVIDENCE AND FINDINGS

4 received from the noticee, the investigating authority vide its letter dated January 23, 2006 required the noticee to be present before it on 27th January, 2006. As the noticee failed to appear before the investigating authority on the said date, one more opportunity was granted to the noticee. In this regard the investigating authority vide its letter dated March 7, 2006 required the noticee to be present before it on 13th March, 2006. It is noted from the evidence available on record that the noticee failed to appear before the investigating authority on the said date.
