The Adjudicating Officer disposed of the adjudication proceedings against the noticees without imposing any penalty, notwithstanding admitted violations of Regulation 25 of the MF Regulations and the Code of Conduct, in view of the fact that the irregularity was committed by an official of the AMC and the AMC had already reimbursed Rs. 2,91,466 to the respective schemes.

2 Sasikant Singh, the branch head of the AMC’s Kanpur branch, with the help of certain brokers. 3. The above said transactions i.e. switching over of one scheme to another and vice versa were in relation to four folios namely; (i) Sarjoo Sahkari Chini Mills Ltd. Employees Contributory PF Trust; (ii) Sarjoo Sahkari Chini Mills Ltd. Employees Gratuity Fund; (iii) Sarjoo Sahkari Chini Mills Ltd. ECPF Trust; (iv) Sarjoo Sahkari Chini Mills Ltd. (hereinafter commonly referred to as Sarjoo). The AMC also conducted an internal investigation on the alleged transactions.

4 It stated that apart from the irregular switches from Gilt Schemes to Equity Schemes, which was result of the fraud perpetrated in the AMC’s branches at Kanpur and Lucknow, there was no other switches of investment or direct investment made by any other PF Trusts in equity schemes. In any event, the Investigation Report suppresses the fact that the Provident Funds (PF) were not just investing in Prudential ICICI Mutual Fund but also in all other Mutual Fund schemes of a similar nature. Hence, as a whole industry, there was no restriction on investment by a PF in any scheme. It is submitted that it is trustees of the PF who decide where to invest and not the AMC or the Fund.
