- 2 - VTL and thereby created artificial volume in the scrip. On the basis of the findings of the investigation, it was alleged that the noticee had violated the provisions of Regulation 4(1) & 4(2) (a) (b) (g) and (n) of PFUTP Regulations and the provisions of Brokers Regulations. - 3 - CONSIDERATION OF ISSUES 8. I have taken into consideration the facts and circumstances of the case, the submissions advanced on behalf of the noticee, the material available on record including the documents relied upon by the noticee.
- 4 - 10. In the instant case, before analysing the violation alleged to have been committed by the noticee in the scrip of VTL during the investigation period, it is pertinent to take into account some significant facts about the scrip of VTL. The investigation report revealed that the scrip was traded for 26 days out of total 26 days available for trading on the exchange during the period of investigation and there was a consistent price rise in the scrip over this period. It was also observed that apart from listing in BSE the scrip is also listed at Hyderabad Stock Exchange (HSE). However, it appears there has been no trading in the scrip on the exchange for a long time and there were no transactions in the scrip from October 2004 to November 2004.
