2 3. Investigation further revealed that MEL opened at a price of Rs.3.90 on June 27, 2003 and closed at Rs.15.62 on August 27, 2003. The aforesaid rise was followed by a fall in price to Rs.5.90 till September 24, 2003 and thereafter further to Rs.2.70 on November 06, 2003. During the rise period the scrip was traded on 43 days with a total volume of 5721123 shares. During the fall period, the scrip was traded on 51 days with total volume of 1520486 shares.

3 APPOINTMENT OF ADJUDICATING OFFICER 7. Mr. Piyoosh Gupta was appointed as Adjudicating Officer vide order dated January 25, 2006 under section 15 I of SEBI Act read with rule 3 of SEBI (Procedure for Holding Inquiry and Imposing Penalties by Adjudicating Officer) Rules, 1995 (hereinafter referred to as ‘Rules’) to inquire into and adjudge the aforesaid alleged violations committed by the Noticee.

After transfer of the case to me, in adherence to the principles of natural justice a hearing notice dated December 24, 2009 was issued to the Noticee for a hearing to be held on January 15, 2010 at SEBI, Head Office, Mumbai. A copy of the SCN dated March 21, 2007 was also sent to the Noticee along with the hearing notice. Both the Notices were issued through the Noticee’s broker namely, Action Financial Services (India) Ltd for delivery. The Noticee failed to reply to the SCN and did not appear for hearing.
