The mere fact that MTL could not detect the purported circular trades since the technology available at the time was inadequate cannot be a ground for imposing liability on MTL. MTL did not, in any manner, actively participate in or assist the purported manipulative trades. The trades were not structured by MTL [in fact, as stated earlier, MTL did not even have knowledge that the trades are circular].
