Page 2 of 36 2. The role of the brokers and their clients who traded in the scrip of Allcargo and Unity on BSE and NSE was scrutinized. It was observed during investigation that certain entities had allegedly indulged in circular/reversal synchronized trading in such a manner that led to creation of artificial volume in the scrips.
Page 3 of 36 6. Vide letter dated August 6, 2010, the Noticee stated that he was desirous of applying for the consent proceedings. Subsequent to this, the Noticee applied for consent hence the proceedings were kept in abeyance. Since the High Powered Committee recommended on November 19, 2010 that the matter may not be settled on the term proposed by the Noticee, adjudication proceedings had been recommenced.
Page 4 of 36 Stock Exchange has put in place an automated price and order matching mechanism of a blind system to ensure perfect transparency in the trading system and therefore, it is impossible to manipulate and execute any circular and reversal of trades. I state and submit that Ms. Anjana Mehta is my wife and Mrs. Usha Mehta is my mother. There are continuous transfer of funds amongst my bank accounts and bank accounts of my wife Ms. Anjana Mehta and my mother Mrs. Usha Mehta, to meet our financial requirements. The funds are used to meet individual and family expenses and other financial obligations as is normal between family members and no adverse inference from the same can be drawn. Similarly, no adverse inference may be drawn upon me having a joint account with my wife and my mother. It’s a family arrangement for sake of financial convenience. As far as 5 bank transfers between Suresh Hanswal and me for amount of Rs. 5,70,000.00 and 1 bank transfer between the Mr. Ajay Roongta and me for an amount of Rs. 5,00,000.00. as shown in Annexure 5 are concerned I state that Mr. Ajay Roongta and Mr. Suresh Hanswal are my friends. It is also true that I have been borrowing and lending money to and them on account of our relationship whenever in need and thus fund flows is observed between him and me and no adverse inference may be drawn there from.
