3 Regulations”) and Clauses A(1) and A(2) of Code of Conduct for Sub- Brokers as specified in Schedule II under Regulation 15 of SEBI (Stock Brokers and Sub Brokers) Regulations, 1992 (hereinafter referred to as “Brokers Regulations”). Consequently the Noticee becomes liable for monetary penalty under sections 15HA and 15HB of Securities and Exchange Board of India Act, 1992 (hereinafter referred to as “SEBI Act”).

After transfer of the case to me, in the interest of natural justice and in order to conduct an inquiry as per rule 4(3) of the Rules, the Noticee was granted an opportunity of personal hearing on January 14, 2010, vide notice dated December 24, 2009 at SEBI, Head Office, Mumbai. Along with the hearing notice a copy of the SCN dated March 21, 2007 was issued to the Noticee through its broker M/s Ramanlal D Shah for delivery against acknowledgment. Both the notices were delivered to the Noticee’s address available with the broker i.e 7, Mangal Building, 2nd Floor, 76/ CRA, Kidwai Road, Matunga, Mumbai - 400019.
