Holding
The Adjudicating Officer concluded that the Noticee, by his intraday transaction of July 29, 2011, did not become beneficial owner of the acquired shares and therefore was not entitled to exercise fifteen percent or more voting rights in the company, so Regulation 10 read with Regulation 14(1) was not triggered. The Noticee's claim that Regulation 10 r/w 14(1) was not applicable since he was not 'entitled' to exercise fifteen percent or more voting rights was held to be a tenable argument.
