Page 2 of 14 March 02, 2015 provisions of Regulations 4 (1) read with 4 (2) (a,b,g,n) of the SEBI (Prohibition of Fraudulent and Unfair trade Practices Relating to Securities Market) Regulations, 2003 (hereinafter referred to as the “PFUTP Regulations”) and Clause A(1) ,(2), D(4),(5) of code of conduct for sub-broker as specified in schedule II (Regulation 15) of SEBI (stock Broker and Sub-broker ) Regulation 1992 and Regulation 7 read with Clause A (1), (2), (3), (4) and (5) of Code of Conduct as specified under Schedule II of the Broker Regulations. (hereinafter referred to as the “Broker Regulations”).

The allegation against the noticee (sub-broker of client Amit S Mehta) is that noticee along with Amrut Securities Ltd (sub-broker of client Hitesh Thakkar ) bought 10,89,454 shares and sold 11,74,602 shares for their clients during the investigation, thereby contributing 13.42%(buy side) and 14.47%(sell side). The noticee allegedly indulged in circular/reversal/synchronized trades, and thus instrumental in creating artificial volume in the scrip which distorted equilibrium in the shares of GAL. were executed by noticee and Amrut Securities Ltd for their clients during the period October 20, 203-November 15, 2003. The act of the broker is in violation as it aided in creating misleading appearance of trading in the market and did not exercise due care and diligence.
