It was, therefore, alleged that the Noticee has failed to obtain SCORES authentication and thereby violated the SEBI Circulars, thus, making the Noticee liable for imposition of penalty under Section 15HB of the Securities and Exchange Board of India Act, 1992 (hereinafter referred to as "the SEBI Act").

Accordingly, on the scheduled date of hearing i.e. August 8, 2017, Mr. Manish Chhangani of Khaitan & Co., AR appeared on behalf of the Noticee and made submissions. The AR stated that the Noticee had been suspended from trading for almost a decade, and was under the impression that it need not obtain SCORES authentication. Hence, the Noticee had not obtained SCORES authentication. The AR further stated that the Noticee had now filed the Form ‘A’ for obtaining SCORES Authentication vide letter dated August 05, 2017, and that the SCORES User ID and Password had also been received by the Noticee. The AR stated that they would submit a copy of the confirmation e-mail from SEBI along with the written submissions on behalf of the Noticee, which would be filed by August 20, 2017.
