The Investigating Authority had also advised the noticee that if it omits to produce the books of accounts and/or documents as required by the Investigating Authority, SEBI shall initiate adjudication proceedings against the noticee and it could be levied the monetary penalty as provided in section 15A of the SEBI Act. 1.3 However, the noticee had failed to furnish the information as sought by the Investigating Authority despite service of the said summonses and the covering letter both dated March 08,2004 on March 12, 2004 and subsequent reminders as stated above.

3 offer and the matter would be proceeded ex-parte and be completed on the basis of material available on record. 2.3 The said notice of hearing along with copy of show cause notice dated July 03, 2007 was sent to the noticee by way of Registered Post, Acknowledgement Due at the address of the noticee available on record. The same was returned undelivered by the Postal Department with remarks “Left”. Therefore, the said notice of hearing and the show cause notice dated July 03, 2007 were served on the noticee on August 06, 2007 by substituted service by pasting the said notices on the premises of the noticee, the address of which was made available to the Southern Regional Office of SEBI. Additionally, the notice dated July 27, 2007 was also hosted on the SEBI website under the head “Unserved Summons/Notices” so as to enable the noticee to avail the opportunity of hearing. 2.4 Vide letter dated August 22, 2007, stated to have been filed on behalf of the noticee, M/s Vaidyanathan Associates, Advocates, inter alia, submitted before the undersigned that : A. The promoter of M/s Origin Agrostar Ltd., Sri Dinesh Dalmia, is in judicial custody since April 2006. B. The Hon’ble High Court of Madras has passed an order of winding up on March 16, 2007 in Company Petition No. 43/2004 against M/s Origin Agrostar Ltd. (the noticee) and all the records are in the custody of the Official Liquidator, Chennai.

4 December 06, 2007 in the matter and the same was communicated to M/s Vaidyanathan Associates, Advocates of the noticee, vide letter no. ADJ/SKS/PS/109399/2007 dated November 27, 2007 with copy to the noticee. Since this letter sent to the noticee was also returned undelivered by the Postal Department the said notice dated 27.11.07 was served upon the noticee through substituted service on December 04, 2007 by pasting the same on its premises at the address found by the Southern Regional Office of SEBI. However, the noticee did not avail the opportunity of hearing despite service of the notice. 2.6 Vide letter no. ADJ/SKS/143344/2008 dated November 05, 2008, enclosing copy of the notices dated July 03, 2007, July 27, 2007, November 13, 2007 and November 27, 2007, one last opportunity of hearing was fixed on November 19, 2008 and the same was intimated to the noticee with copy to M/s Vaidyanathan Associates, Advocates. The said letter was sent to the noticee by way of Registered Post, Acknowledgement Due at the addresses as available on record and on that which was made available by Southern Regional Office of SEBI as stated above. These addresses are as following : M/s Origin Agrostar Ltd. (formerly known as DSQ Biotech Ltd.) Global Towers, No. 79 (New No. 183), TTK Road, Vth Floor, Alwarpet, Chennai – 600018. And M/s Origin Agrostar Ltd. (formerly known as DSQ Biotech Ltd.) 29/15, CIT Nagar, 3rd Main Road Chennai – 600035.
